Ask An Attorney About:  Estate Planning

What is estate planning?

Estate planning is the process of preparing for how you will leave your assets after you pass away, how your medical and funeral wishes will be carried out, setting up guardianship for any children, and the management of your affairs after your passing. It can include a will, power of attorney, and probate services.

What documents will you help me with for estate planning?

An estate plan often includes last will and testament, a living will or advance directive, a power of attorney, and may also include trusts, beneficiary designations, and other documents based on individual circumstances. We will work with you to make sure your estate plan matches your exact wishes, and covers your exact assets.

What happens if someone dies without an estate plan in Tennessee?

If someone dies without doing any estate planning, their assets, final wishes, and other considerations will be handled based on Tennessee’s laws of intestate succession. Typically this means there will be a division of assets among surviving spouses, children, and other close relatives, but this will have to be handled in probate court.

Can I change my estate plan?

Yes, it is actually a great idea to change your estate plan as your life changes. If you have a shift in financial circumstances, or change your mind about how you’d previously decided to do things, we at Vance Law Office, PLLC, can work with you to make sure the changes you want are properly included in your estate plan.
